A few days ago I read that the COF de Madrid wants its members to have a earring protocol<\/strong><\/a>. Sounds like a great idea to me because there really are major problems of responsibility<\/strong>, but beyond that I think there are things to take into account and that I leave to reflect. What slopes? Can they get piercing? Is the same? Can the pharmacy do it? Is age important?<\/strong><\/p>\n

First of all, I do want to clarify that this topic fully enters into regional regulations<\/strong> and here I am going to talk about how the situation is in general.<\/p>\n

Also, I am not going to delve into topics as relevant as they are consents essential<\/strong> and that any earring can generate health problems with consequent responsibilities<\/strong>.<\/p>\n

What is an earring and what is a piercing<\/strong><\/h4>\n

The first question is to define what is an earring and what is a piercing. Well, the Royal Spanish Academy of the Language<\/a> does not contemplate the word piercing, but only pending<\/strong> and defines it like this: \u00ab5.<\/strong> m. Earring with or without hanging ornament. 6.<\/strong> m. Jewel that is worn hanging. \u00bb  It does not say that it has to be in the ear,<\/strong> in the navel or other part of the body, nor does it speak of techniques. So what we call a piercing in English is a piercing in our language.<\/p>\n

What the regional regulations say<\/strong><\/h4>\n

The regional regulations that regulate non-health centers for tattoos, micropigmentation, piercings or other similar techniques<\/strong>, which is where piercings are usually done, they put earrings, they make dilations and, of course, they tattoo every last centimeter of the body, they do not differentiate between earrings and piercings<\/strong>.<\/p>\n

For example: In Madrid: Decree 35\/2015 defines: \u00abPiercing and similar practices: Procedure for decoration of the human body consisting of the piercing of any part of the body<\/strong>, in order to light metal objects or other materials in it. In Castilla y Le\u00f3n Decree 44\/2003, of April 15, defines "the ringed or perforated (" piercing ")" as the "procedure of decoration of the human body with jewels or other objects that consists of fastening them to the body through the skin, mucous membranes and other body tissues<\/strong>\u201d.<\/p>\n

And so we can see different regional regulations<\/a> that do not differentiate between earring and piercing<\/strong>. An exception is Catalonia<\/strong> where there is a clarification in Decree 90\/2008, of April 22: \u00abPiercing: procedure for decorating the human body consisting of piercing skin, mucous membranes or other tissues with the purpose of hanging jewelry and metal objects. Earlobe piercing using the automatic, sterile or single-use earring technique is excluded from the definition of piercing.<\/strong>. \u00bb<\/p>\n

Given that the specific regulations of authorized non-health centers do not differentiate it for me, it is difficult for me to affirm in a categorical way that an earring is only one that goes on the earlobe and that if it goes up a little more we are already talking about piercing. More logical is what the Catalan regulations say where technique is important, but this is not contemplated by all regional regulations.<\/p>\n

Anyway, we might think that in these tattoo centers they do not put pending and that this is a pharmacy thing, but it is not true, because in them they are pending and are expressly regulated, unlike the pharmacy where the limits are not clear : What happens if the pharmacy puts an earring in the earlobe and a dilation is started? Do we call it piercing or earring? What if there is already an earring and we put a second, is this a piercing? And so we could keep asking ourselves questions.<\/p>\n

Pharmaceutical management regulations<\/strong><\/h4>\n

An added problem we have is that Nor do the pharmaceutical regulations say that the pharmacy can put earrings in the earlobe <\/strong>but not elsewhere on the body, including the top of the ear. Nor does it make a difference between whether what is pierced is cartilage or flesh or bone. Nor is it said that a piercing is curved or not.<\/p>\n

In short, if we look at regulations, we can question many things and conclude that we are facing a complex situation.<\/strong><\/p>\n

The custom in putting on the earrings<\/strong><\/h4>\n

However, out of habit, which is also a source of the law, the pharmacy has always been pending<\/strong> and these are put on the earlobe, because that has also been the custom<\/strong> And this is something cultural, as cultural as the dilations of the ears and lips that are done in some African areas. We can affirm without a doubt that it has been customary to put earrings on girls as soon as they are born, although if we are objective those earrings are nothing more than piercings.<\/p>\n

Therefore, if we have to justify that they are pending in the pharmacy it is by custom, not because a law expressly enables it to do so (at least as a general rule), in the same way as before in public hospitals it is also by habit they put them on newborn babies, although they don't usually do it now.<\/p>\n

Another different question is to answer the following questions: Is putting an earring a health issue? Or is it an aesthetic issue? <\/strong>And if it is aesthetic, is the pharmacy competent? Where do we put the limit? Is putting it on a baby the same as an adult? Does liability insurance cover putting earrings? If we consider it public health, then can the pharmacy put tattoos? How and where do we set the limit?<\/p>\n

Anyway, complex subject, with a great dose of custom and cultural connotations.<\/strong><\/p>\n
